Welcome to Fair Winds Coffee Traders (FWCT)! These Terms and Conditions (“Terms”) govern your access to and use of our website, online store, and services (collectively, the “Site”). By accessing or using the Site, placing an order, or creating an account, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

Our Products and Services
FWCT sells fresh roasted coffee beans and ground coffee and related products. All coffee products are perishable food items. We strive to provide high-quality, fresh coffee, but flavor and freshness can vary based on storage, brewing methods, and personal taste.

Orders and Purchases

By placing an order, you represent that you are at least 18 years old and legally capable of entering into binding contracts.
All orders are subject to acceptance by us. We reserve the right to refuse, cancel, or limit any order for any reason, including product availability, errors in pricing or description, or suspected fraud.
Prices are shown in U.S. dollars and are subject to change without notice. Taxes and shipping fees will be calculated at checkout.
Payment is processed through secure third-party providers. We do not store full payment card details.

Shipping and Delivery
We ship orders within the United States. Shipping times are estimates only and not guaranteed. Risk of loss or damage passes to you once the package is handed to the carrier. We are not responsible for delays caused by carriers, customs, or events beyond our control.

For perishable items like coffee, we recommend prompt inspection upon delivery and proper storage to maintain freshness.

Returns and Refunds
All sales are final with no returns accepted due to the perishable nature of coffee. Please refer to our full Returns and Refunds Policy for details regarding quality issues within the 14-day window, exclusions, and non-refundable shipping costs.

Accuracy of Information
We make reasonable efforts to ensure product descriptions, images, and pricing are accurate. However, errors may occur. We reserve the right to correct errors and update information without prior notice. Colors and packaging may vary slightly from images shown.

Intellectual Property
All content on the Site – including text, images, logos, product photos and branding – is owned by FWCT or its licensors and protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our prior written consent.

User Accounts and Conduct

If you create an account, you are responsible for maintaining the confidentiality of your login information and for all activities under your account.

You agree not to:

Use the Site for nay unlawful purpose
Submit false or misleading information
Interfere with the Site’s operation or security

We reserve the right to terminate or suspend accounts at our discretion.

Limitations of Liability
To the fullest extent permitted by law, FWCT shall not be liable for nay indirect, incidental, special, consequential, or punitive damages arising from your use of the Site, purchase of products, or any related issues (including but not limited to loss of profits, data, or coffee freshness after delivery).

Our total liability to you for any claim shall not exceed the amount you paid for the specific product(s) giving rise to the claim.

Disclaimers
The Site and all products are provided “as is” without warranties of any kind, express or implied. We do not warrant that the Site will be error-free, uninterrupted, or that products will meet your personal taste expectations. Coffee is subjective, and results depend on brewing and storage.

Indemnification
You agree to indemnify and hold FWCT, its owners, employees, and affiliates harmless from any claims, damages, or expenses (including reasonable attorney fees) arising from your violation of these Terms or misuse of the Site or products.

Changes to These Terms
We may update these Terms from time to time. Continued use of the Site after changes
constitutes acceptance of the new Terms. We will post the updated date at the top of this page.

Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Ohio and applicable U.S. federal law, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the state or federal courts located in Knox County, Ohio.

Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
